1. Introduction
These Terms of Service (“Terms”) govern your use of There247 (“There247”, “we”, “us”, “our”). By creating an account or using our services, you agree to these Terms.
2. The Service
There247 provides AI-powered call answering and communication services. The service may answer inbound calls forwarded by your business, collect caller information, generate call transcripts and summaries, and send notifications to your business.
Important: There247 is a support tool. It is not a call centre, employee, agent, or representative of your business. You remain responsible for operating your business independently of the service.
We do not guarantee that all calls will be answered, routed successfully, or handled without error.
3. Eligibility
You must be at least 18 years old and have authority to enter into these Terms on behalf of your business.
4. Account Responsibilities
You are responsible for maintaining account security, controlling access to your account, and ensuring all information provided is accurate.
5. Customer Responsibilities
You agree to comply with applicable laws, ensure lawful call forwarding and call handling, provide appropriate notice to callers, and ensure your staff use the service appropriately.
You are responsible for correctly configuring call forwarding, notification settings, contact details, and any customer-side setup required for the service to operate.
You are solely responsible for any decisions, actions, or outcomes arising from calls handled through the service.
6. Acceptable Use
You must not use There247 to collect highly sensitive information, handle emergency or life-critical situations, engage in illegal or harmful activities, mislead callers, violate privacy laws, or misuse the system through spam, excessive automated calls, scraping, or abnormal usage.
We may impose reasonable usage limits or take action where usage is excessive, abnormal, or inconsistent with intended use.
7. AI Limitations
There247 uses AI systems to assist with call handling. AI responses may be imperfect, incomplete, or incorrect. The service is not a substitute for legal, medical, financial, emergency, or other professional advice.
8. Telecommunications and Third-Party Dependencies
The service depends on third-party providers, including telecommunications carriers, call forwarding systems, infrastructure providers, AI providers, and messaging providers.
We are not responsible for call forwarding failures, network outages, carrier issues, third-party service delays, or failures outside our reasonable control.
9. Fees and Billing
You agree to pay all applicable fees. Pricing is provided at signup or via agreement. Payments may be processed by third-party providers such as Stripe.
Failure to pay may result in suspension or termination.
Free trials, if offered, are limited in duration and may automatically convert to paid subscriptions unless cancelled before the end of the trial.
Fees are non-refundable except where required by law.
10. Data and Privacy
Our handling of personal information is described in our Privacy Policy. You retain ownership of your business data and grant us a limited licence to process data to provide the service.
11. Data Retention and Deletion
Upon termination of your account, data may be retained for a limited period for operational, legal, or security purposes, and will then be deleted or de-identified in accordance with our Privacy Policy.
12. Intellectual Property
There247 owns all rights in the platform, software, systems, and service. You retain ownership of your data. You may not copy, modify, reverse engineer, or misuse the service.
13. Beta / Early Access
The service may be in beta or early release. Features may change and the service may contain bugs or incomplete functionality.
14. Service Availability
We aim to provide reliable service but do not guarantee uptime. We may modify, improve, maintain, suspend, or discontinue parts of the service where necessary.
15. Suspension and Termination
We may suspend or terminate your account if you breach these Terms, fail to pay fees, misuse the service, or create risk for There247, other customers, callers, or third-party providers. You may cancel your account at any time.
16. Limitation of Liability
To the maximum extent permitted by law, There247 is not liable for indirect, incidental, special, consequential, or exemplary damages.
We are not liable for missed calls, delayed responses, loss of revenue, loss of customers, or lost business opportunities.
Our total liability is limited to the amount paid by you in the previous 3 months.
17. Indemnity
You agree to indemnify There247 against claims arising from your use of the service, your breach of these Terms, your failure to comply with laws, or your failure to provide appropriate caller notice.
18. Force Majeure
We are not liable for delays or failures caused by events outside our reasonable control, including outages, natural events, telecommunications failures, third-party service failures, cyber incidents, or regulatory actions.
19. Changes to the Service or Terms
We may update the service or these Terms from time to time. Continued use of the service after changes are published constitutes acceptance.
20. Governing Law
These Terms are governed by the laws of New Zealand.

There247 Data Processing Addendum (DPA)

This Data Processing Addendum (“DPA”) forms part of the There247 Terms of Service (“Agreement”) and applies where There247 processes personal data on behalf of a customer (“Customer”).
1. Roles of the Parties
The Customer is the data controller, or equivalent. There247 is the data processor, or service provider.
There247 processes personal data only on documented instructions from the Customer, including through use of the service, or as required by applicable law.
There247 is not responsible for determining whether Customer instructions comply with applicable law.
2. Scope of Processing
Subject Matter
Provision of AI-powered call answering and communication services.
Duration
For the term of the Agreement, plus limited retention as described in this DPA and the Privacy Policy.
Nature and Purpose
Processing includes receiving inbound calls, capturing caller information, generating transcripts and summaries, sending notifications to the Customer, and maintaining limited caller context.
Processing is limited to what is necessary to provide, secure, and support the service.
Types of Personal Data
- Name
- Phone number
- Call content and transcripts
- Call summaries
- Call metadata

Callers contacting the Customer.
3. Customer Responsibilities
The Customer is responsible for ensuring lawful collection and processing of personal data, providing appropriate notice to callers, obtaining consent where required, ensuring lawful instructions, and ensuring appropriate use of the service.
The Customer must not provide or instruct There247 to process sensitive or special category personal data unless expressly agreed in writing.
4. There247 Obligations
There247 will process personal data only to provide the service, not sell personal data, implement appropriate safeguards, ensure authorised personnel are bound by confidentiality obligations, and limit processing to what is necessary for the service.
5. Subprocessors
The Customer authorises There247 to use subprocessors.
There247 will use reputable and appropriate service providers, impose data protection obligations on subprocessors, remain responsible for subprocessor performance in relation to data protection obligations, provide notice of material subprocessor changes where reasonably practicable, and make subprocessor information available upon request.
6. Security Measures
There247 implements appropriate safeguards, including role-based access controls, tenant isolation, authentication and access controls, secure data storage, monitoring, and logging.
Security measures are designed to protect against unauthorised access, loss, misuse, or disclosure of personal data.
7. Data Breach Notification
There247 will notify the Customer without undue delay after becoming aware of a personal data breach affecting Customer data.
Notification will include available information to assist the Customer in meeting its legal obligations.
8. Data Subject Rights
Taking into account the nature of processing, There247 will assist the Customer, where reasonably practicable, in responding to requests from individuals exercising their rights.
9. Assistance and Cooperation
Taking into account the nature of processing and the information available, There247 will provide reasonable assistance to the Customer with data protection impact assessments, regulatory or supervisory authority requests, and compliance with applicable data protection laws.
10. Data Retention, Return and Deletion
Upon termination of the Agreement, personal data may be retained for a limited period for operational, legal, or security purposes. Upon written request, data may be returned where reasonably practicable. Thereafter, data will be deleted or de-identified in accordance with the Privacy Policy.
11. International Transfers
Data may be processed in countries outside the Customer’s jurisdiction. There247 will take reasonable steps to ensure appropriate safeguards are in place, including contractual protections where appropriate.
12. Audit and Compliance
There247 will make available reasonable information to demonstrate compliance with this DPA, which may include documentation or written responses.
Formal audits are not included unless agreed separately.
13. Liability
Liability under this DPA is subject to the limitations in the Terms of Service, including any liability caps.
14. Governing Law
This DPA is governed by the same law as the Agreement.
